Terms of Service

These terms apply to your use of whisknwag.co and to any order you place with Whisk & Wag ("we", "us", "our"). By browsing this site or placing an order, you agree to them. Please read them before you buy.

1. Who can order

You must be at least 18 years old, or have the consent of a parent or guardian, to place an order. By ordering you confirm that the payment method you use is your own or that you have permission to use it.

2. Products and descriptions

We work hard to describe our products accurately, including sizing and suitability for cats and dogs. Even so, colours can vary between screens, and packaging or minor design details may change between production batches.

Our products are everyday pet-care accessories. They are not veterinary or medical devices. Nothing on this site is veterinary advice. If your pet has a health condition, is on a special diet, or you are unsure whether a product suits them, please speak to your vet first.

Always supervise your pet when introducing new equipment, and follow the manufacturer's instructions supplied with the product.

3. Prices and payment

All prices are shown in US dollars (USD) and exclude shipping unless stated otherwise. Shipping is calculated at checkout, and you will always see the full amount before you pay.

We may change prices at any time, but changes will not affect orders we have already accepted. If a product is listed at an obviously incorrect price due to a technical or human error, we may cancel the order and refund you in full rather than honour that price. We will contact you if this happens.

Customers outside the United States may be charged import duties, taxes or customs fees on delivery. These are set by your country and are your responsibility, not ours.

4. Orders

Placing an order is an offer to buy. A confirmation email acknowledges we received your order; the contract forms when we dispatch it. We may decline or cancel an order if the item is out of stock, if we cannot verify payment or delivery details, if we suspect fraud, or if the order appears to be for resale.

You can cancel within 24 hours of ordering, provided it has not shipped. See our refund & return policy.

5. Delivery

Delivery times given on our shipping & returns page are estimates, not guarantees. Once a parcel is handed to the carrier, transit times are outside our control, and delays caused by carriers, customs or weather are not something we can be held liable for. We will always help you trace a delayed or missing parcel.

Please make sure your delivery address is correct at checkout. We cannot redirect a parcel once it has shipped, and we are not responsible for orders lost because an incorrect or incomplete address was supplied.

6. Returns and refunds

Our full returns terms, including the 30-day window, hygiene exclusions and who pays return postage, are set out in our refund & return policy, which forms part of these terms.

7. Your use of this site

You may browse, shop and share our content for personal, non-commercial purposes. You may not scrape or copy the site systematically, resell our content, attempt to gain unauthorised access to our systems, introduce malicious code, or use the site in any way that breaks the law or interferes with other customers.

8. Intellectual property

The Whisk & Wag name, logo, site design and original text and images are ours and are protected by copyright and trade mark law. Product images and specifications supplied by manufacturers remain the property of their respective owners. Nothing here grants you a licence to use our branding without written permission.

9. Reviews and content you submit

If you send us a review, photo or other content, you keep ownership of it but grant us permission to display it on our site and marketing channels with attribution to your first name. Please only submit content that is your own and does not infringe anyone else's rights. We may decline or remove content that is abusive, misleading or unlawful.

10. Third-party services

This store runs on Shopify, and payment processing, analytics and shipping are handled by third-party providers. Their handling of your data is covered by our privacy policy and their own terms. Links to external sites are provided for convenience; we are not responsible for their content or practices.

11. Disclaimers and limitation of liability

The site is provided on an "as is" and "as available" basis. We do not warrant that it will be uninterrupted or error-free.

To the fullest extent permitted by law, our total liability to you in connection with any order is limited to the amount you paid for that order. We are not liable for indirect or consequential losses.

Nothing in these terms limits or excludes our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot lawfully be excluded. If you are a consumer, these terms do not affect your statutory rights under the law of your country, and where that law gives you stronger protection than these terms, that law applies.

12. Governing law

These terms are governed by the laws of the State of Wyoming and the United States, and disputes will be handled by the courts of that jurisdiction. If you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer protections and the right to bring proceedings in your local courts where the law of your country provides that right.

13. Changes to these terms

We may update these terms from time to time. The version published on this page at the moment you place an order is the version that applies to that order.
